These terms govern your access to and use of the Xenmark marketing site and Xenmark application. By using the service, you agree to these terms. Subscribers who process personal data using the service are also subject to the Data Processing Agreement (DPA). For questions, contact [email protected].

1. Agreement to terms

By accessing the Xenmark marketing site (www.xenmark.app) or the Xenmark application (my.xenmark.app), you agree to these terms. If you do not agree, do not use the service.

2. The service

Xenmark provides a web-based PDF drawing review and comment coordination tool for project teams. The marketing site (www.xenmark.app) is informational only. The application (my.xenmark.app) provides projects, drawing uploads, revision management, structured comment threads with annotations and replies, status tracking, role-based access, exports, and project archive/close-export flows.

Xenmark is intended for ordinary professional PDF drawing review coordination. It is not intended as permanent storage, certified document control, a legal archive, or a safety-critical record system. Users requiring certified document control, regulatory compliance archiving, or safety-critical record-keeping should use a system designed for those purposes.

Xenmark is intended for business, commercial, professional, internal company, and freelance use only. By creating an account or using Xenmark, you confirm that you are using the service for those purposes and not as a private consumer.

3. Accounts

  • You are responsible for the accuracy of the information you provide when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for activity that occurs under your account.
  • Xenmark may suspend or terminate accounts that violate these terms or applicable law.

4. Acceptable use

You agree not to use Xenmark to:

  • Upload content you do not have the right to upload.
  • Upload classified, highly sensitive, safety-critical, legally critical, high-value, or regulated content that requires certified document control or compliance with regulatory archiving standards.
  • Use Xenmark as a permanent storage system, certified document control system, legal archive, or safety-critical record system — it is not designed or warranted for these purposes.
  • Violate any applicable law, regulation, or third-party right.
  • Attempt to disrupt, reverse engineer, or compromise the service.
  • Use the service to harass, abuse, or harm others.

5. Your content

You retain ownership of the drawings, comments, and project data you upload to Xenmark. You grant Xenmark the limited rights necessary to host, display, process, and back up that content for the purpose of operating the service. Xenmark does not claim ownership of your project data.

You are responsible for deciding whether your drawings, comments, attachments, exports, and related material are suitable for Xenmark. You are also responsible for keeping your own records, exports, and backups of anything you need to retain. Xenmark is a coordination tool for ordinary professional PDF drawing review, not a permanent archive or system of record.

6. Roles and access

Xenmark uses role-based access: Project Manager, Editor, and Participant. Each role grants a specific set of permissions inside a project. The Project Manager is responsible for inviting members, assigning roles, and managing project content. Editors may upload drawings, add comments and annotations, reply, change statuses, and export. Participants may view project content, add replies, and export, but may not create comments, annotations, upload drawings, or change statuses.

7. Pricing and billing

Xenmark offers Free, Plus (€14.99/mo), and Pro (€59.99/mo) plans. Plan limits are described on the pricing page. Billing is managed through the Xenmark application:

  • Billing is processed by Stripe.
  • Subscription fees are charged in advance for the chosen plan and billing period.
  • Plan changes, cancellations, and refund eligibility follow the terms published within the Xenmark application billing flow.

8. Service availability

Xenmark aims for high availability but does not guarantee uninterrupted access. Scheduled maintenance, upgrades, and unforeseen incidents may temporarily affect the service.

9. Disclaimer

Xenmark is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Xenmark disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

10. Limitation of liability

To the maximum extent permitted by law, Xenmark and its operators are not liable for indirect, incidental, special, or consequential damages arising from use of the service.

11. Termination

You may stop using the service at any time. Xenmark may suspend or terminate access for violation of these terms. On termination, your project data will be handled according to the data retention practices described in the Privacy Policy. For details on data processing and subprocessors, see the Data Processing page.

12. Changes to these terms

Material changes to these terms will be communicated through the application and reflected in the "Last updated" line above.
